As per the Preferential Procurement Regulations 2017, the evaluation criteria must remain objective to ensure that enterprises have a fair chance of advancing to the next evaluation stage, which includes Price and B-BBEE.
While most tenders are evaluated based on Functionality, an Organ of State will outline the tender evaluation process in the tender documents.
Typically, the tender documents specify the evaluation criteria for measuring functionality and include details such as:
- The points allocated for each criterion and any sub-criteria.
- The minimum qualifying score needed to progress, generally set between 65% and 85% out of 100%.
Tenders that fall below the minimum qualifying score will be deemed non-responsive and will not advance to the Price and B-BBEE evaluations.
When an Organ of State establishes the minimum qualifying scores for Functionality, these scores should:
- Avoid being overly generic.
- Be defined separately for each tender.
- Not be set too low to jeopardize the quality of the goods or services required.
- Not be established so high that they become unattainable.
All tenders that meet the minimum qualifying score for functionality must proceed to further evaluations regarding Price and B-BBEE, in line with the preference point systems outlined by the Preferential Procurement Regulations 2017.
