Tender Preparation Time

It is often asked if there is mention in the Preferential Procurement Policy Framework Act that specifies how much lead time there should be for responding to tenders. The answer is, the Preferential Procurement Policy Framework Act does not make provision for any time period.

In the SUPPLY CHAIN MANAGEMENT: A GUIDE FOR ACCOUNTING OFFICERS OF MUNICIPALITIES AND MUNICIPAL ENTITIES there is a paragraph that guides municipalities on the timeframes for responding to tenders.

In paragraph 4.5.2.5 it states:

Tender adjudication process

The SBD/WCBD6.1 document must form part of all bids invited.  It contains general information and serves as a claim form for preference points for Broad -Based Black Economic Empowerment (B -BBEE) Status Level of Contribution, and explains how tenders or bids are decided.

The document says:

  • The bidder obtaining the highest number of points will be awarded the contract.
  • Preference points shall be calculated after prices have been brought to a comparative basis.
